US CPSC Exempts Certain Unfinished Manufactured Fibers from Third Party Testing for Heavy Metals and Phthalates
On June 1, 2020, the US Consumer Product Safety Commission (CPSC) enacted a final rule in the Federal Register determining that certain unfinished manufactured fibers do not contain phthalates and ASTM F963 heavy metals in excess of the specified concentrations under CPSIA. This determination allows that any accessible component parts, which are made with these unfinished manufactured fibers, in children''s toys and childcare articles would not be required to have third-party testing done for compliance and certification purposes. The effective date of this rule is July 1, 2020.

US CPSC Adopts ASTM F2050-19 for Hand-Held Infant Carriers in Direct Final Rule
On May 20, 2020, the U.S. Consumer Product Safety Commission (CPSC) published a direct final rule to approve ASTM F2050-19 and incorporate 16 CFR 1225, which is the Safety Standard for Hand-Held Infant Carriers into the federal regulation. The effective date will be August 3, 2020.

US State of Maryland Approves to Amend the Restriction of Flame Retardants Rule for Children''s Products and Furniture
On May 8, 2020, the US State of Maryland enacted Senate Bill SB447 to amend the State's Restriction of Flame Retardants Rule for Children''s Products and Furniture. The new law will come into force on January 1, 2021, and the Maryland Department of Health will adopt the new requirements starting from June 1, 2021.

New Version of EN 71-7 Toy Safety Standard for Finger Paints is Published
In April 2020, the European Committee for Standardization (CEN) published the third amendment to EN 71-7 (i.e. EN 71-7:2014+A3:2020). Any conflicting national standards are to be withdrawn by October 2020. It is expected this standard will be published in the Official Journal of the European Union (OJEU) as a harmonised standard for the Toy Safety Directive (TSD) 2009/48/EC.

Korea Implements New Safety Requirements for Children''s Products
The South Korean Ministry of Trade, Industry and Energy (MOTIE) implemented new chemical requirements in the Common Safety Standards for Children's Products according to Notice No. 2019-201. The changes came into effect as of June 4, 2020.

Consumer Product Safety Commission (CPSC) Amends the Federal Standard for the Flammability for Mattresses and Mattress Pads (16 CFR PART 1632)
On October 6, 2020, the CPSC voted unanimously (4-0) to approve publication, as drafted, in the Federal Register to issue a notice of proposed rulemaking (NPR) to establish a consumer product safety standard for crib mattresses.

CPSC Publishes Notice of Proposed Rulemaking Within the Federal Register for the Safety Standard for Crib Mattresses
On October 26, 2020, the U.S. Consumer Product Safety Commission (CPSC) staff published within the Federal Register a Notice of Proposed Rulemakings for a Safety Standard for Crib Mattresses (16 CFR 1241). Public comments on the Crib Mattress NPR may be submitted until January 11, 2021.

U.S. CPSC Releases Briefing Package on Status Update of 16 CFR Part 1610
On September 30, 2020, the Consumer Product Safety Commission (CPSC) published a Briefing Package that summarizes potential updates to the 16 CFR part 1610 rule. The package also responds to comments received on the 2019 Request for Information (RFI) about possible exemptions from testing and other changes to 16 CFR part 1610.

The US FTC Proposes Made in USA Labeling Requirement
On July 16, 2020, the Federal Trade Commission (FTC) published notice of a proposed Made in USA Labeling Rule. The FTC is seeking comments related to "Made in USA" and other U.S. Origin claims on product labels ("MUSA claims:"). The public comment period ends on September 14, 2020.

US EPA Issues Final Rule on Long-chain Perfluoroalkyl Carboxylate (LCPFAC) and Perfluoroalkyl Sulfonate Chemical Substances
On July 27, 2020, the U.S. Environmental Protection Agency (EPA) issued a final significant use rule (SNUR) for long-chain perfluoroalkyl carboxylate (LCPFAC) and perfluoroalkyl sulfonate chemical substances. This is under citation, 85 Fed. Reg. 45109. The final rule will be effective on September 25, 2020.

The US State of Maine Enacts Reporting Rule of Priority Chemicals (PFOS) in Electronics and Children''s Products
On July 28, 2020, the Maine Department of Environmental Protection published Chapter 890 on Designation of PFOS and Its Salts as Priority Chemicals. It requires reporting for certain children's products that contain Perfluorooctane Sulfonic Acid ("PFOS") or its salt. The rule took effect immediately.

Health Canada Publishes New Test Method for Flammability of Toys
On July 20, 2020, Health Canada published a new version of Method F02 Flammability of Toys (Dolls, Plush toys, and Soft Toys). The new test method was effective on the date of issuance.

Denmark Announces New Phthalates Restriction on Toys and Children''s Products
On June 26, 2020, the Danish Ministry of Environment and Food published Executive Order BEK no. 947 of 20/06/2020 related to the prohibition of phthalates in toys and articles for young children not exceeding 0.05% by mass. The Executive Order entered into force on July 1, 2020. The preceding Executive Order no. 855 of September 5, 2009 has been repealed.

California''s ''Toxic-free Cosmetics'' Act Signed into Law banning 24 substances in cosmetic products
On September 30, The Toxic-Free Cosmetics Act known as Assembly Bill 2762 was signed into law. Starting January 1, 2025, a person or entity manufacturing, selling, delivering, holding of offering for sales in commerce any cosmetic product that contains the intentionally added ingredient under the bill is prohibited.

New Jersey Legislature passes "Strongest Single-Use Ban On Plastics In The Country"
On September 24, the New Jersey Assembly passed legislation banning single-use plastic bags and paper bags at large grocery stores. It also prohibits the use of polystyrene foam containers at restaurants, and makes plastic straws with meals by-request only. The bill would come into force in the spring of 2022.

FTC amends rules and regulations under the Textile Fiber Products Identification Act
The U.S. Federal Trade Commission (FTC) has amended the Rules & Regulations Under the Textile Fiber Products Identification Act to incorporate the latest ISO 2076 standard: ISO 2076:2013(E), "Textiles-Man-made fibres-Generic names." This incorporation by reference will promote international consensus along with providing manufacturers selling textiles products in multiple countries with more flexibility in the labeling of textile products.

COVID-19 Impact: China Sourcing Suggests W-Shaped Recovery While Manufacturing Struggles in Rest of Asia

Throughout Q2 2020, global supply chains have remained in the grip of the COVID-19 pandemic. Lockdowns in buying and manufacturing regions are triggering dramatic yet erratic drops in demand and supply. As global trade enters the second half of 2020, it is emerging that the pandemic has not redrawn the maps of global sourcing - but it has accelerated and deepened a number of pre-existing trends. Among them are decreased reliance on China, diversification of supplier portfolios and more advanced use of digital and remote tools to manage quality and compliance.

China Sourcing in W-Shaped Recovery Following Lockdown and Demand Shock

QIMA data on inspection and audit demand in China shows that so far in 2020, China sourcing has followed a distinct W-shaped pattern of decline and recovery. After the initial stall during the COVID-19 lockdown (-33% YoY in January-February 2020), manufacturing showed signs of recovery in March (-12% YoY), followed by another downturn in April (-22% YoY) as demand from Western buyers collapsed. With restrictions easing in the West, it would appear that China sourcing is due for another - potentially more lasting - rebound. Demand for inspection and audits picked up from May onward (-5.5% YoY in May, +1% YoY in June).

EU buyers have played an important part in China's rebound, with demand for inspections and audits spiking by +16% YoY in May and +28% in June. Meanwhile, many US buyers are finding it hard to make a clean break from China: inspection demand in Q2 was down -12%, far from the expected cliff edge drop. Indeed, in a July QIMA survey that polled 200+ businesses globally on their sourcing patterns, 87% of US respondents still cited China among their top three sourcing geographies, and 60% did more than half of their sourcing from China. Furthermore, QIMA data suggests that in some sectors, US brands continue to rely heavily on China and, in some cases, increasingly so. For example, Electrical and Electronics inspections in China for US-based buyers recorded an uptick of +7.5% YoY in May and 15% in June 2020.

US CPSC Publishes New Safety Standard for Gates and Enclosures
On July 6, 2020, the U.S. Consumer Product Safety Commission (CPSC) published a final rule establishing a safety standard for gates and enclosures that are intended to confine a child. The final rule 16 CFR 1239 adopts the existing ASTM F1004 - 19, Standard Consumer Safety Specification for Expansion Gates and Expandable Enclosures. The CPSC is also amending its regulations regarding third party conformity assessment bodies to include the safety standard for gates and enclosures in the list of notices of requirements (NORs). The rule will come into effect on July 6, 2021.

Addition of Four New Substances to the SVHC Candidate List
On June 25, 2020, the European Chemicals Agency (ECHA) added 4 new substances to the Candidate List of Substances of Very High Concern (SVHC) under Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH). The additions include three substances that are toxic to reproduction and one endocrine disruptor. The Candidate List now contains 209 substances that may have serious effects on people or the environment.

EU Publishes New Version of Standard for Drinking Equipment for Young Children
On June 3, 2020, the European Committee for Standardization (CEN) published the EN 14350:2020 drinking equipment intended for young children. Any conflicting national standards will be withdrawn by June 2021.

Australia Publishes New Safety Standards for Projectile Toys
On June 12, 2020, the Australian Competition and Consumer Commission (ACCC) announced an updated mandatory safety standard for projectile toys. It is designed to protect children from serious eye injuries or choking from toys such as bow and arrow sets and toy guns. Starting June 12, 2021, suppliers must meet the requirements of the Consumer Goods (Projectile Toys) Safety Standard 2020.

Australian New Safety Standard for Aquatic Toy
On June 26, 2020, the Australian Competition and Consumer Commission (ACCC) announced an updated mandatory safety standard for aquatic toys. It is designed to protect children when they are using inflatable aquatic toys in and around water. Starting June 13, 2022, suppliers must meet the requirements of the Consumer Goods (Aquatic Toys) Safety Standard 2020.

Korea Revises Food Contact Requirements
In May, the Korea Ministry of Food and Drug Safety (MFDS) issued Notice No. 2020-43 announcing a revision for the 'Standards and Specifications for Food Utensils, Containers and Packaging'.

US CPSC Revises Safety Standard for Sling Carriers
In January 2017, the US Consumer Product Safety Commission (CPSC) issued a consumer product safety standard for Sling Carriers. The standard incorporated by reference the applicable ASTM voluntary standard. The CPSC is publishing this direct final rule revising the CPSC's mandatory standard for Children's Chairs and Stools to update to ASTM F2907-19 with an effective date of July 6, 2020.

US State of California Issues Safe Use Determination for Exposures to BPA from Certain Polycarbonate Eyewear Products in Proposition 65 Regulation
In April 2020, the California Environmental Protection Agency's Office of Environmental Health Hazard Assessment (OEHHA) issued a Safe Use Determination (SUD) to The Vision Council (TVC) member companies related to exposure to bisphenol A (BPA) from certain polycarbonate (PC) eyewear products that are manufactured, distributed, or sold by them.

US Recalls Summary (July 1, 2019 to March 31, 2020)
In the US, when hazards are identified in consumer products, they will be recalled and published in the Consumer Product Safety Commission (CPSC) Recent Recalls on the CPSC website, which is updated daily. The US recalls from July 1, 2019 to March 31, 2020 are summarized here.

Canada Issues Updated Standard on Flammability and Labelling of Tents
In April 2020, the Canadian General Standards Board: Standards Council of Canada published a new flammability and labeling requirement for tents, CAN/CGSB-182.1. This standard applies to consumer tents for outdoor use (including tents intended for both indoor and outdoor use), such as camping tents, backpacking tents, suspended tents, teepees, children's tents, tent trailers, ice-fishing tents, dining shelters, sun shelters and screen houses.

Health Canada Publishes Consumer Product Annual Surveillance Report
According to the annual surveillance report published by Health Canada in 2019, the Consumer Product Safety Program (CPSP) received 2,504 incident reports (2,343 consumer product reports and 161 cosmetic reports) from consumers and industry. A similar number of incident reports were received in 2018. Toys is the top reported product type and half of its reports are associated with an injury. The number of reports submitted voluntarily was also consistent between 2018 and 2019.

EU Proposes to Revise REACH Annex XVII
On April 23, 2020, the World Trade Organization (WTO) circulated Notification G/TBT/N/EU/714 from the European Union (EU) proposing to amend Annex XVII to Regulation (EC) No. 1907/2006 (REACH). The changes are proposed to be implemented in phases starting in the fourth quarter of 2020.

Japan Revised the Approved List for Food Contact Plastic
In April 2020, the Japan Ministry of Health, Labor and Welfare (MHLW) published a new version of the positive list of substances approved for use in plastic food contact materials, which will be implemented starting June 1, 2020.

On December 2, 2020, Bill S8817 was signed into law by the Governor of New York State State.

US Consumer Product Safety Commission issued a COVID-19 Related Products Business Guidance
The CPSC issued a business guidance for four main categories of products which are commonly being used during the COVID-19 pandemic including face coverings, gowns, gloves and disinfectant and cleaning products.

The European Union (EU) has revised the list of European Standards for Products Drafted in Support of the General Product Safety Directive (GPSD)
On December 1st, 2020, the European Union (EU) issued Implementing Decision (EU) 2020/1808 amending Implementing Decision (EU) 2019/1698 for certain child care articles, children's furniture, stationary training equipment, and the ignition propensity of cigarettes in regards to the list of standards that give a presumption of conformity to the General Product Safety Directive (GPSD) (Directive 2001/95/EC). The new decision became effective on December 1, 2020.

Hong Kong Proposes to Update its Safety Standards for Toys and Children's Products.
Hong Kong Government launched a public consultation on the proposed update to Schedule 1 and 2 to the Toys and Children's Products Safety Ordinance (Cap.424). These Schedules implement up-to-date safety standards promulgated by the relevant standards institutions for toys and children's product listed in Schedule 2 of the Ordinance (Schedule 2 products).

The Standardization Administration of China (SAC) Published GB/T 4146.1-2020, Superseding GB/T 4146.1-2009
The Standardization Administration of the People's Republic of China recently released announcement No.22 of 2020, which included an update that GB/T 4146-2020 "Textiles-Man-made fibers-Part 1: Generic names" has replaced the 2009 version. It will be effective on May 1, 2021.
