Historic Cannabis Reform Passes House Committee
For the first time, a measure to remove federal restrictions on
cannabis has not just received a vote in a House committee but passed.
Introduced by Rep. Jerrold Nadler (D, NY-10, pictured at right), H.R.
3884, the Marijuana Opportunity Reinvestment and Expungement Act (MORE
Act) passed on a bipartisan vote of 24-10 in the House Judiciary
Committee on November 19.
The bill can now be brought to the floor for a vote by the full
House of Representatives. If it passes, it will then be sent to the
Senate.
The act, which includes elements from several cannabis-reform bills
recently put forward in Congress, would deschedule cannabis, allow
expungement of certain cannabis offenses for individuals, and impose a
5 percent tax that would be reinvested in communities adversely
impacted by the War on Drugs.
The Drug Enforcement Administration (DEA) currently classifies
cannabis under Schedule
I of the Controlled Substances Act, a designation given to
substances that have a high potential for abuse and no medical value.
It is illegal under federal law for any Schedule I substance to be
“prescribed, dispensed, or administered for medical use.” Other
Schedule I substances include LSD and heroin. Cocaine and
methamphetamine are classified as Schedule II, so they can be
prescribed.
A key provision in the MORE Act would deschedule cannabis, meaning
it would be removed entirely from the Controlled Substances Act. ASA
has been advocating for the descheduling of cannabis since the
organization’s inception in 2002.
“This groundbreaking legislation would eliminate barriers to
cannabis research and provide access for patients throughout the
entire country,” said ASA Interim Director Debbie Churgai. “It is time
our federal government steps up to provide relief so that patients
everywhere can medicate without fear of losing any of their civil
rights and protections, including while in federal housing or
healthcare settings, such as hospices.”
If the MORE Act is signed into law, it will remove a barrier to
insurance companies covering the costs of cannabis for patients. ASA’s
survey of over 500 medical cannabis patients found that affordability
remains a significant challenge in states with medical cannabis
programs, as described in ASA's “2019
State of the States Report: An Analysis of Medical Cannabis Access in
the United States.”
“For far too long we’ve treated marijuana as a criminal justice
problem instead of a matter of personal choice and public health,”
said Rep. Nadler. “Arresting, prosecuting and incarcerating people at
the federal level is unwise and unjust.”

Health Officials Say Prohibition Stymies Vape Response
An official from the Centers for Disease Control and Prevention
(CDC) told congress last month that their investigation into
vaping-related lung injuries and deaths has been hampered by the
Schedule I status of cannabis.
CDC Principal Deputy Director Anne
Schuchat told a Senate committee that they have had difficulty
shipping samples for testing due to cannabis being illegal under
federal law and that legal barriers were “delaying” the agency’s
analysis. The CDC has been working with various state health
departments to identify hazards in vaping products, but those products
need to be shipped to be analyzed.
More than 2,000 people have been reported to have lung injuries
associated with vaping, and at least 39 have died. At the beginning of
November, the CDC announced that vitamin E acetate was found in the
lungs of 29 affected individuals in 10 states and has been identified
as a “strong culprit” in the illness. Vitamin E acetate has been found
in some illicit-market THC vape cartridges, but the FDA reports
finding THC in only 70% of the nearly 600 vaping products linked to
the disease that they have tested.
At the same hearing, an official from the Food and Drug
Administration’s (FDA) suggested that if they could identify
responsible parties, which is unlikely for any operating in the
illicit market, they might pursue them under the Food, Drug and
Cosmetic Act.
On October 1, Americans for Safe Access issued patient-focused
recommendations on cannabis vaping products. An independent
analysis performed by CannaSafe, a PFC-certified lab in California,
found that 10 types of underground market cannabis vape cartridges all
contained myclobutanil, a pesticide that becomes poisonous hydrogen
cyanide when heated. Heavy metals have also been identified in some
cartridge designs.

DEA Increases Research Cannabis Quota
The Drug Enforcement Administration
(DEA) will authorize a 30 percent increase in research cannabis
cultivation from what was produced in 2019. The DEA noted that the
number of registered researchers requesting cannabis for studies
increased more than 40 percent last year to 542 individuals.
Medical research studies approved by the Food and Drug
Administration are limited to using cannabis provided by the DEA from
the one licensed source in the U.S., a farm at the University of
Mississippi run by the National Institute on Drug Abuse (NIDA).
For several years, the DEA has faced criticism for limiting access
to research cannabis. The NIDA cannabis has also been criticized for
being of substantially lower quality and potency than the cannabis
commonly available in the U.S.
Court cases and petitions have sought to create additional licenses
for the cultivation of research cannabis, but despite a ruling from a
DEA administrative law judge that issuing such licenses would be in
the public interest, no new licenses have been approved.
It has been more than three years since DEA announced it would approve
more licenses and began taking applications, but the Department of
Justice has not processed any of the more than two dozen filed.

Advocacy.”

PFC-certified analytical lab CannaSafe will present their vape report
and address corporate responsibility. PFC Director Heather Despres
will conclude the program with a presentation on the importance of
third-party testing in the cannabis industry. The event will be

Unity 2020 Theme and Scholarship Info Released
ASA has announced the theme and opened scholarship applications for
the 2020
National Medical Cannabis Unity Conference: “Campaigning for
Cannabis: Making Policies Work for Patients.”
Each year ASA extends full and partial scholarships to patients and
advocates all over the country to attend the Unity conference so their
voices and stories are heard in Congress and during the conference.
Part of the mission at Americans for Safe Access is to ensure that
medical cannabis patients can engage in the political process
regardless of their financial situation.
“During Unity I made friends that will last a lifetime!” says 2019
scholarship recipient Tonya San. “Uniting advocates from all over the
United States for one common goal, ASA gave us the tools to really get
out there and make a difference and save people's lives!”
The scholarship deadline is January 5, 2020. To qualify for a
scholarship, applicants must commit to attending ASA’s congressional
lobby day during the conference in March, and applicants must have
taken action or attended an event with ASA in the last year.
Scholarship recipients will be contacted regarding scholarships by
January 18, 2020.
Funding for the conference scholarship program is limited, so this
year ASA may have to award scholarships to only one attendee

ASA Keynote on Patients’ Rights at CannaWest Summit
ASA’s William Dolphin will deliver the keynote address at the
seventh CannaWest Compliance Summit in Los Angeles, California, on
Friday, January 24 from 8:30-9:00 AM. Dolphin’s presentation on
“Medical vs. Recreational—Patients’ Rights and Other Considerations”
opens day two of the summit. The day will be devoted to medical
issues, research and development, and Hemp and CBD.
Speakers at the summit include Holly Johnson, PhD, chief science
officer for American Herbal Products Association; Mara Gordon, founder
of Aunt Zelda’s; Brad Rowe, policy director at the UCLA Cannabis
Research Initiative; as well as state officials from Oregon and
California; city oversight officers from Detroit, Denver, Portland,
Seattle, Oakland, Los Angeles, and San Francisco; and operation
officers from leading cannabis companies. Aaron Smith, executive
director of the National Cannabis Industry Association will deliver
the keynote on day one of the summit.
On Wednesday, January 22, the day before the compliance summit,
conference organizers are offering a “cannabis master class” on
business matters. The CannaWest summit will be held January 22-24,

Check the Patient’s Travel Guide before Holiday Travel
The holidays are a peak travel time,
and patients traveling out of state need to know if medicine will be
available in the states they visit. ASA’s Medical
Cannabis Patient’s Guide for U.S. Travel outlines cannabis laws in
states and territories in which they may be eligible. It also includes
information on patient rights, tips for travel, storing cannabis, and
using a retail dispensary.
The laws and regulations reported in this guide were last updated
on September 1, 2019. Before traveling, it is important to review the

laws and regulations are subject to change.

Activist Profile: Cherron Perry-Thomas, Philadelphia,
Pennsylvania
Cherron Perry-Thomas says she has long
lived by Nelson Mandela’s adage that “a threat to justice to anywhere
is a threat to justice everywhere.” After more than a dozen years in
the natural products industry, Cherron came to realize that part of
that threat is not having access to medical cannabis.
“My mission has been to give people alternatives for their wellness
goals,” Cherron says. “If you have a headache, you may think tylenol
is the only avenue to go down, if you don’t know about white willow
bark or other alternatives.”
After teaching vegan nutrition classes out of her home, in 2005
Cherron started Green
Dandelion Marketing, a sales and marketing company that has helped
introduce almost 2,000 innovative plant-based products in grocery and
health stores in the mid-Atlantic region.
Her interest in the therapeutic potential of cannabis began even
earlier, when a neighbor disclosed that using Marinol, the synthetic
THC pills that can be prescribed, was the only way to control the
vomiting from cancer treatment, but the medicine was very expensive,
and cannabis would be cheaper but was illegal and hard for the
neighbor to obtain.
“Being a law-abiding citizen, cannabis was something I knew little
about and had never wanted to pursue, but that was the first
connection with treatment I made,” Cherron says. It was
eye-opening.”
At the time, Pennsylvania had no medical cannabis law, but Cherron
says she knew she the herbal remedies she had were not going to help
her neighbor. So when advocates and legislators in the state started
to talk about medical cannabis, she paid attention to the moms with
children with severe conditions and the patients who were lobbying for
it. She still didn’t see herself in it, but her background equipped
her to understand how it important it was.
“I knew there are many viable solutions to wellness,” Cherron says,
“And it’s a plant. It’s a plant. It shouldn’t be viewed as it is, as
something evil.”
When Pennsylvania in 2016 enacted a medical cannabis law
recognizing 23 qualifying conditions, Cherron had come to understand
it holistically – medical, nutritionally – and historically.
“People could go in a pharmacy 83 years ago and buy a THC product,
but then that got prohibited due to racism, which made me angry,”
Cherron recalls. “People had something they used but then lost due to
bad policies.”
Through her company, she had a wealth of experience working with
biodynamic plants and medicine made from plants. She says she had a
“gradual bonding” with the possibilities of cannabis, once
Pennsylvanians could apply for a card from the state, and decided to
continue with the education she had been doing with herbs, just now
with cannabis, too.
“The more I talked to black and brown communities, it was clear
they were not making the connection that they can use this plant for
their conditions,” Cherron recalls.
Outreach was the answer. In 2018, Cherron cofounded with Desiree
Ivey the Diasporic
Alliance for Cannabis Opportunities (DACO), the first
minority-owned cannabis conference on the East Coast. DACO offers a
conference workshop format geared to black and brown communities where
experts and professionals—doctors, researchers, dispensary
owners—cover wellness, education. The 2019 DACO conference was a free
two-day event September 27-28 at Temple University in Philadelphia,
with a legislative day Friday and seminars Saturday.
“People need to see this is something lawmakers are engaged with
and they can be involved,” Cherron says. “We need to reach people over
40, those who vote and who officials listen to. One way is through
church, the other through politicians.”
The cost of medicine is still at the front of Cherron’s concerns.
She’s been working this session in support of SB
350, an adult use bill, which would allow co-ops where people can
grow together. “Allowing personal cultivation would have major
economic benefit,” Cherron says. “I know one family where three people
are working to provide for the mother.”
Her experience working with plants has shown her that reduced cost
is not the only benefit.
“The garden can be a holistic space,” Cherron says. “The plant can
be therapeutic, but taking care of the plant can also be therapeutic
for the caregiver and the patients.”
Last June, Cherron was part of a rally in the state capital of
Harrisburg for legislators to see communities harmed by the war on
drugs, asking for equity and inclusion. She’s currently chair for the
Plant Medicine Community and is part of All
Together Now PA, which is uniting urban and rural communities to
build regional economies that work for all.
“We need to support and promote a local supply chain,” says
Cherron. “As we move forward with new laws, it’s important to have
language that protects local farmers.”

Tests were conducted for plant

In 23 cases, THC or its metabolites were present, and 16 had nicotine
in their lungs.
Thanksgiving is a peak travel time in
the U.S., with millions of Americans visiting loved ones. Patients
traveling out of state may not know if their medicine will be
available in the states they visit. ASA’s
Staff from Americans for Safe Access and
ASA’s Patient Focused Certification (PFC) program presented
information and trainings last month, with more in November and
December.
On November 8, ASA Interim Director
Debbie Churgai joined PFC Director Heather Despres 
Eryck Stamper had no question about
his career path. Military service is the family business. His parents,
uncles, grandfather and great grandfather had served in the armed
forces. When he committed at age 18 to join the U.S. Navy, he did a
shot with his recruiter and his mother at the bar where she worked. By
the end of a distinguished 23-year career in the Navy, including
multiple naval deployments in support of Desert Shield/Enduring
Freedom, Somalia, and multiple relief efforts, he was coming to grips
with having become “a hardcore alcoholic.”
With the Food and Drug Administration
(FDA) dragging its feet on issuing rules for hemp-extract production,
a bipartisan group of three Democrats and three Republicans are
cosponsoring a bill that would regulate cannabidiol(CBD) as a dietary
supplement. Currently, the only CBD product that can be legally
marketed is the pharmaceutical drug EpidiolexTM, which has
been approved only for use with children who have rare seizure
disorders. The FDA has sent letters to several retailers of CBD
products, telling them to stop making health-related claims.
The Mississippi
Secretary of State’s office announced last month that it had certified
the petition signatures for

Without medical cannabis, likely not

Colorado joined Illinois and New York in
allowing cannabis to be recommended by authorized healthcare providers
for any condition for which an opioid would be appropriate.
Colorado's SB-013 allows Colorado physicians to authorize individuals
to use medical cannabis instead of opioids, including for acute pain.
The bill also removes specific specialist physician requirements for
patients who are minors and allows them to consume non-smokable forms
of cannabis on school grounds. The law went into effect August 2,
2019. ASA provided 
In April, New Mexico passed SB 204,
which allows for the administration of medical cannabis in schools.
This law would not have been possible without ASA’s hardworking New
Mexico chapter advocates. The District of Columbia recently followed
suit with a similar rule change.

workshops, a veterans’ roundtable discussion and a Cannabis 101
course. Conference panels addressed barriers to patients, global CBD
developments including hemp, and advocacy in the courts. ASA’s annual
awards banquet recognized the accomplishments of advocates.
Patrick Seifert was named Veteran Advocate of the Year. CannaSafe was
Business Advocate of the Year. Patient Advocate of the Year was Todd
Larkin. The Courage Award went to longtime activist Diana Dodson. ASA
Chapter of the Year was Safe Access Colorado. Researcher of the Year
went to Jeffrey Raber, PhD. The Medical Professional of the Year was
Cathleen Graham. Journalist of the Year was Tom Angell. Elected
Official of the Year was Maryland Delegate Cheryl Glenn. Check out a

In January, ASA staff travelled to
Prague, Czech Republic to join experts from around the world for the
Annual Global Network Meeting of the International Cannabis and
Cannabinoid Institute (ICCI). During the meeting ICCI staff and
strategic partners, such as ASA, were presented with an overview of
current projects and new initiatives for 2019. ASA's Patient Focused
Certification (PFC) and Cannabis Care Certification (CCC) projects
were among the topics discussed.
Marvin Washington
played as a defensive end for 11 seasons in the NFL, as a Jet, a
49er, and a Bronco. A Superbowl winner and Sports Illustrated’s 36th
best NY Jet, his illustrious career came with a serious cost, however.
Marvin served as a powerful voice for former players in the NFL
concussion lawsuit. His advocacy is focused on the use of cannabis as
both a neuroprotectant and as a pain reliever. He shares our belief
that medical cannabis can help relieve the national health crisis of
opioid overdoses. Besides his advocacy, Marvin works as an
entrepreneur focused on the cannabis industry. He serves as the NFL
league ambassador and a member of the board of Athletes For
CARE.
Anna Symonds is a
world class rugby player who has won the 2014 USA Rugby Division I
National Championship. She was selected for the National All-Star
Competition and the 2003 Sydney Premiership Championship. She
represented the USA in the 2015 Touch Rugby World Cup and is a three
time national champion with the Portland Hunters. She also competes in
mixed martial arts. Anna works as an educator and advocate with East
Fork Cultivar’s CBD certification program. She has pledged her brain
for concussion research and supports the work of The Concussion Legacy
Foundation. She also serves as a member of Athletes for
CARE.
Bipartisan support in both the House of
Representatives and Senate is propelling new federal measures to
support medical cannabis research.
We want to do our best to demonstrate
our gratitude to our members and supporters. That's why we've recently
adopted a few improvements to our
What's in a name? Marijuana, Cannabis,
and Hemp
Art was the point of entry into cannabis advocacy
for Erik Range. In 2015, after a trip to Colorado, where he saw the
expansion of the cannabis industry, Erik began wondering how, as a
minority, he could take part in the economic benefits. His solution
was Art420, a company that uses fine art exhibitions to challenge
cannabis stereotypes. He put on shows a couple of years in a row,
including one in the Florida state capitol and pop-up shows in
California.
"As much as we wanted to talk to state officials
about social equity issues, it was a nonstarter in Florida at that
time, so we focused on diversity," Erik says. "We coauthored language
now in the law to include diversity requirements for equity, staffing
and contracts."
In a historic decision with global
implications for drug policy, the United Nations Commission on
Narcotic Drugs (CND) has reclassified cannabis to recognize its
medical value. The 53 member states of the CND voted 27 to 25 with one
abstention in favor of adopting the World Health Organization's (WHO)
recommendations to remove cannabis and its resin from the most
restricted international category, Schedule IV. The U.S. voted in
favor of the change.
In a historic vote, the U.S. House of
Representatives passed the bipartisan?Marijuana Opportunity
Reinvestment and Expungement Act (MORE Act). The bill moves to the
Senate for consideration. If enacted, the MORE Act would remove
cannabis from drug control scheduling and enable a national approach
to safe access.
The pandemic prevented ASA's Patient
Focused Certification staff from attending the conferences and events,
but PFC was able to participate in a number of notable online events.
?The International Cannabis Bar Association, MJBiz, ASTM, Analytical
Cannabis, Abilities Expo, Social Impact Center, and the Hemophilia
Foundation of Northern California, to name a few, heard about the
value of third-party certification.
The pandemic has limited travel for
many people, but for medical cannabis patients who are embarking on
trips, it is still important to be aware of the legal aspects.

canceled or postponed, Americans for Safe Access held its 8th Annual
National Medical Cannabis Unity conference online on March 27, 2020.
The change to an online format allowed ASA to make the conference even
more accessible by lowering the cost of attendance and making
recordings of the expert panels available to watch any time.
Early in April, ASA announced the

purpose in the world at Bates College, but he enjoyed the respect of
his peers on campus, where he framed his open cannabis use as civil
disobedience. After he graduated in 1989, he embarked on
self-treatment experiments with a number of alternative substances to
boost his mood, including l-tryptophan for a year until it was banned
nationally after a bad batch came out.
Dan got involved with ASA in 2015, when he got a
scholarship to attend the annual Unity conference in Washington, D.C.
There he connected with other patient advocates and discovered a
community that understood his experience (pictured with fellow New
Hampshire advocate Heather Marie Brown at ASA''s 2019 Lobby Day). He's
attended every year since, including this year's online
conference.
Americans for Safe Access is one of
several cannabis advocacy organizations that sent a letter last week
to House leaders, urging Congress to address safe banking access in
federal relief efforts. Yesterday, House Democrats unveiled their
latest bill, which includes provisions to allow cannabis businesses to
use financial services available to other businesses. If passed by the
Congress and signed into law, this reform would have far-reaching
effects for patients and the cannabis industry.?

experience includes more than a dozen years doing product development,
she suspected the emerging cannabis edible industry presented
opportunities. Texas had just opened applications for cannabis edible
manufacturers, so she submitted her plan, one of 43 to do so. The
process has been slow - only three licenses have so far been awarded,
and just two are operational - but it has brought Nico into contact
with patient advocates in the state. She credits the "autism moms" and
patients in Texas with a new outlook that extends deep into her
life.
Nico's experience in product
development for FritoLay and Pepsico means she is used to working with
analytical labs and has been inside all the largest food manufacturing
facilities in the U.S. and Canada.

the connection between the war on drugs and the disproportionate
impacts of police misconduct on African-Americans.

PFC Director Heather Despres is

of the Science of Cannabis Extraction Online Symposium. Despres will
explain Good Manufacturing Practices (GMP) and third-party
certification and auditing as a tool for cannabis and hemp
businesses.
The American Sociological Association
has recognized a book coauthored by Michelle Newhart PhD and ASA's
William Dolphin with a prestigious award.?The Medicalization of
Marijuana: Legitimacy, Stigma, and the Patient
Experience?(Routledge 2019) has won the Donald W. Light Award for
the Applied or Public Practice of Medical Sociology. The book is based
on a qualitative research study of patients enrolled in Colorado's
program.
Joy Grainge turned to medical cannabis
after she injured her neck in 2006, developed spinal stenosis, and
then discovered that she had arthritis throughout her body. That was
eight years before Illinois, where she lives, got a medical cannabis
program running, so she had to rely on the underground market for
access.
Joy's citizen lobbying has always been
a combination of state, local and federal, but she's also done
outreach within her church.
But, the fight for patients in the United States is
still not over.? While this is a momentous occasion for patients
everywhere, the U.S. government still classifies cannabis as a
Schedule I drug in the U.S. Control Substances Act (CSA).? Schedule I
of the CSA is the most restrictive category for drugs in the U.S. and
does not recognize that cannabis has medical use.??
The federal government classifies
cannabis as a Schedule I substance under the Controlled Substances
Act, meaning it is considered to be a dangerous, highly addictive
substance with no medical value. The only protection for state medical
cannabis programs in federal law is a budget bill, subject to change
each year, that prohibits the Department of Justice from spending
money targeting medical cannabis patients or the programs in which
they are enrolled. Plans for legalization at the federal level have
been introduced for years with little impact. Of those, the Marijuana
Opportunity Reinvestment and Expungement Act of 2019, H.R.3884, is the
first and only bill of this nature to clear a Congressional committee.
It is time for a new approach to end the federal conflict on cannabis
policy.
Last month, the U.S. Department of
Agriculture (USDA) 
The USDA released its Interim Final Rule on
Hemp on October 31, 2019. Americans for Safe Access (along with almost
4,700 other organizations and individuals) submitted comments on the
new rule before the public comment period closed on January 29,
2020.

"I got my medical card then, which
might seem counterintuitive, but I felt it was a political issue," she
says. "I needed to take a stand that I use this medically, that this
is a medical issue."
